Bart Ross, appellant, was convicted on two counts of engaging in organized criminal activity for an aggravated assault committed by appellant and two co-defendants. See Tex. Penal Code Ann. 71.02 (West Supp. 2000). On appeal, appellant complains that (1) the evidence is legally and factually insufficient to support his conviction because his actions did not come within the statutory requirements of an organized criminal activity, (2) the trial court improperly refused to submit a requested instruction to the jury, and (3) the trial court erred in denying his motion for new trial. We will reverse the convictions for organized criminal activity, render judgment that appellant is guilty of the lesser-included offense of aggravated assault, and remand the cause to the trial court for a new sentencing hearing.
